Terms of Service

Welcome to Bermly ("the Platform," "we," "us," "our"). These Terms of Service ("Terms") govern your use of Bermly, a website that allows users to post and browse listings for dirtbikes.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. What We Are

Bermly is a classified listings platform only. We provide a venue for private individuals to advertise dirtbikes for sale and for other users to browse those listings.

We are not a party to any transaction between users. We do not:

  • Buy, sell, or take ownership of any vehicle listed
  • Process, hold, or handle any payment between buyers and sellers
  • Verify the identity of any user, the ownership, condition, safety, legality, or roadworthiness of any listed vehicle, or the accuracy of any listing information
  • Guarantee that any listing is genuine, that any vehicle is free of finance, theft, or defects, or that any transaction will be completed

All negotiations, payments, inspections, and transfers of ownership occur directly between buyer and seller, entirely off-platform. You transact at your own risk.

2. Eligibility

You must be at least 18 years old and able to form a legally binding contract under Australian law to use the Platform.

3. Listings

By posting a listing, you (the seller) represent and warrant that:

  • You are the lawful owner of the vehicle, or are authorised to sell it on the owner's behalf
  • The vehicle is not stolen and is free of any undisclosed finance, encumbrance, or security interest, or you have disclosed any such interest clearly in the listing
  • All information in the listing (including odometer/hours, condition, history, and photos) is true, accurate, and not misleading
  • You will comply with all applicable state and territory laws regarding the sale and transfer of the vehicle (including any registration transfer, roadworthy certificate, or notification requirements that apply in your state)
  • You hold or have rights to use any photos or content you upload

We reserve the right to remove any listing, at our discretion, without notice, including listings we believe to be fraudulent, misleading, for a stolen vehicle, or in breach of these Terms.

4. Buyer Responsibility

If you are considering purchasing a vehicle through a listing on the Platform, you are solely responsible for:

  • Independently verifying the identity of the seller
  • Inspecting the vehicle in person before payment
  • Checking the vehicle's status on the Personal Property Securities Register (PPSR) at ppsr.gov.au to check for finance, theft, or write-off records
  • Confirming legal ownership and any registration/transfer requirements in your state or territory
  • Making your own assessment of the vehicle's condition, safety, and value

We strongly recommend meeting sellers in person in a safe public location and never sending payment for a vehicle you have not inspected.

5. Prohibited Conduct

You must not use the Platform to:

  • List a stolen vehicle or a vehicle you do not have the right to sell
  • Post false, misleading, or deceptive information
  • Misrepresent a vehicle's odometer, hours, condition, or history
  • Engage in scams, fraud, or attempt to defraud another user
  • Harass, threaten, or abuse other users
  • Post content that infringes another person's intellectual property or privacy
  • Use the Platform for any unlawful purpose

6. No Warranty

The Platform and all listings are provided "as is" without any warranty of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

7. Limitation of Liability

To the maximum extent permitted by law, Bermly and its owners/operators will not be liable for any loss, damage, claim, or dispute arising from:

  • Any transaction, or failed transaction, between users
  • The condition, legality, safety, ownership, or roadworthiness of any listed vehicle
  • The accuracy of any listing or communication between users
  • Any loss of money, property, or vehicle arising from a scam, fraud, or misrepresentation by another user

Nothing in these Terms excludes any consumer guarantee or right that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth) or other applicable Australian law.

8. Disputes Between Users

We are not responsible for resolving disputes between buyers and sellers. If a dispute arises, we encourage you to contact:

  • Your state or territory Fair Trading / Consumer Affairs office
  • Police, if you believe you have been the victim of fraud or theft
  • Your state or territory road transport authority or ppsr.gov.au, for vehicle registration, write-off, or security interest inquiries

9. Reporting a Listing

If you believe a listing is fraudulent, misleading, or breaches these Terms, please report it using the "Report Listing" function or contact us at support@bermly.com.au.

10. Termination

We may suspend or terminate your access to the Platform at any time, for any reason, including breach of these Terms.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of that state/territory.
